RPC opinion: impact of draft Commonhold and Leasehold Reform Bill
The Regulatory Policy Committee gave a 'green' rating to the draft impact assessment from the Ministry of Housing, Communities and Local Government on 1 May 2026.
The UK government is reforming leasehold property ownership to shift towards commonhold tenure and restrict ground rents, addressing long-standing issues with leasehold costs and leaseholder protections. Led by the Department for Levelling Up, Housing and Communities, the reform includes the Leasehold and Freehold Reform Act 2024 and proposals to ban leasehold for new flats while enabling existing leaseholders to convert to commonhold. The policy is active with recent focus on ground rent restrictions, retirement communities, and contractual land controls.

Today, the Government have published and laid the Commonhold and Leasehold Reform Bill in draft for pre-legislative scrutiny by the Housing, Communities and Local Government Select Committee.

Improving the fairness and transparency of service charges and rebalancing the legal costs regime will significantly strengthen leaseholder consumer rights.
These Regulations bring into force section 27 of the Leasehold and Freehold Reform Act 2024 (c. 22) (“the Act”) on 31st January 2025. This removes the two year qualifying period for leasehold enfranchisement and lease extension claims.
